These Terms and Conditions constitute a legally binding agreement between you (the “Student” or “User”) and Winfrench Academy (the “Academy,” “we,” “us,” or “our”), based in Windsor, Ontario, Canada, governing your use of our online French language services. By enrolling in any course or using our services, you agree to be bound by these T&Cs.
1. Services and Enrollment
1.1 Scope of Services
The Academy provides online French language instruction, including personalized tuition, group classes, and specialized preparation courses for official exams (e.g., TEF Canada, DELF A1-B2). All services are delivered virtually (e.g., via Google Meet, Zoom) by certified instructors.
1.2 Enrollment and Acceptance
Enrollment is confirmed upon our receipt of your completed registration form and the full or initial payment of the Course Fee. We reserve the right to accept or reject any application for enrollment at our sole discretion.
2. Fees and Payment
2.1 Course Fees
All course fees are clearly stated at the time of registration. Unless otherwise specified, all fees are quoted in Canadian Dollars (CAD).
2.2 Payment Schedule
Fees are generally payable in advance. For individual tuitions, payment terms will be agreed upon during enrollment (e.g., $20/hour for personalized sessions). Group class fees may require upfront payment for the entire session period.
2.3 Non-Refundable Items
Registration fees, placement test fees, and any fees associated with official exam submissions are typically non-refundable.
3. Cancellations, Refunds, and Transfers
3.1 Course/Tuition Cancellation by the Student
- Notice Period: Students must provide written notice (e.g., via email to winfrenchacademy@gmail.com) to cancel enrollment.
- Refunds (General): Refunds for tuition fees (excluding non-refundable items) will be processed based on the Academy’s specific refund schedule, which may depend on the duration of notice given before the course start date or during the course.
- Absences: No refunds or credits will be provided for individual lessons or group sessions missed by the student.
3.2 Official Exam (TEF Canada) Transfers and Cancellations
The following terms apply specifically to TEF Canada exam bookings made through or referred by the Academy:
- Transfer/Cancellation Window: Transfers or cancellations are possible only up to 15 days before the scheduled exam date.
- Refund Fee: If cancellation is accepted within the window, a non-refundable CAD 75 fee will be deducted from the refund amount.
- Late Cancellation: No refunds are provided for cancellations made less than 15 days before the exam date.
- Retakes: Re-registration for the TEF exam is only permitted after a 20-day waiting period following the previous attempt.
4. Student Conduct and Responsibilities
4.1 Online Learning Environment
Students agree to maintain a positive, respectful, and focused learning environment at all times during live online sessions. Disruption, harassment, or non-compliance with instructor requests may lead to suspension or expulsion without refund.
4.2 Account Security
The Student is responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
4.3 Academic Integrity
Any form of academic dishonesty, including plagiarism, cheating, or assisting others in academic dishonesty, will result in immediate disciplinary action, up to and including expulsion without refund. This includes any fraud or misconduct related to official TEF/DELF exams.
5. Intellectual Property (IP)
All course materials, including presentations, videos, recordings, workbooks, and proprietary teaching methodologies (“Course Content”), are the exclusive intellectual property of Winfrench Academy or its licensors. You are granted a limited, non-transferable license to use the Course Content solely for your personal, non-commercial educational purposes.
6. Limitation of Liability
The Academy will use reasonable care and skill in providing the services. However, to the fullest extent permitted by law, the Academy shall not be liable for any indirect, incidental, special, or consequential damages arising from your enrollment or use of the services.
7. Governing Law and Jurisdiction
These T&Cs shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein.
8. Amendments
We reserve the right to modify these T&Cs at any time. Changes will be effective immediately upon posting to the website. Your continued use of the services after any such changes constitutes your acceptance of the new T&Cs.
